Welcome to Forge (forge.playamigos.in), a product of Forge by PlayAmigos("we," "us," or "our"). By accessing or using Forge, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Forge ("the Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date and, for significant changes, by email. Continued use after changes constitutes acceptance.

2. Description of Service

Forge is an AI-powered learning application that generates personalized daily lessons on topics of your choosing. The Service uses multiple specialized AI agents to design curricula, write lessons, generate quizzes, grade responses, and adapt content based on your performance and feedback.

3. Account Registration

To use Forge, you must create an account with a valid email address and password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 13 years of age to create an account and use the Service (or 16 in jurisdictions where GDPR applies with a higher age of consent).

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to solicit others to perform unlawful acts
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Use the Service to generate content that is harmful, hateful, harassing, or abusive
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated scripts, bots, or scrapers to access the Service
  • Republish AI-generated lessons or quizzes for commercial purposes without permission

5. AI-Generated Content

Forge uses artificial intelligence to generate lessons, quizzes, grading feedback, and curricula. While we strive for accuracy through fact-checking agents and multi-stage review pipelines, AI-generated content may contain errors, inaccuracies, or outdated information. The Service is intended for educational purposes and should not be relied upon as the sole source of truth for any professional, medical, legal, or financial decisions.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You acknowledge and accept the inherent limitations of AI-generated educational material.

6. Community Content

Forge allows users to publish their completed learning paths for others to discover and enroll in ("Community Content"). By publishing a learning path:

  • You grant Forge by PlayAmigos a non-exclusive, worldwide, royalty-free license to host, display, and distribute the published content through the Service
  • Published content is permanent and cannot be unpublished or deleted from the public catalog
  • You represent that the content does not infringe on any third-party rights
  • We reserve the right to remove any Community Content that violates these Terms

7. Intellectual Property

The Forge platform, including its design, code, AI agents, branding, and user interface, is the intellectual property of Forge by PlayAmigos. Your AI-generated lessons and learning data remain associated with your account but are generated using our proprietary AI pipeline.

8. Data Processing & Privacy

Your use of the Service involves the processing of personal data as described in our Privacy Policy. By using the Service, you acknowledge that:

  • Forge by PlayAmigos acts as the data controller for your personal data
  • Your learning data is processed by third-party AI providers to generate educational content
  • Your data may be stored and processed in data centers outside your country of residence
  • You have the right to access, export, and delete your data at any time through the Settings page

9. Service Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Forge by PlayAmigos shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Note: Some jurisdictions (including the EU and certain Australian, Canadian, and South African laws) do not allow the exclusion of certain warranties or limitations on liability. In such cases, our liability shall be limited to the maximum extent permitted by applicable law, and statutory consumer rights are not affected.

11. Termination

We may suspend or terminate your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Any published Community Content will remain available.

You may terminate your account at any time by using the Delete Account feature in Settings. Upon deletion, all your personal data is permanently removed as described in our Privacy Policy.

12. Indemnification

You agree to indemnify, defend, and hold harmless Forge by PlayAmigos and its affiliates from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution: Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith informal negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 of India. The seat of arbitration shall be Bangalore, India.

International Users: If you are accessing the Service from outside India, you agree that these Terms are governed by Indian law. However, nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your jurisdiction. Your privacy rights under GDPR, CCPA, LGPD, DPDP Act, or other local laws are fully respected as described in our Privacy Policy.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, pandemic, power failures, internet outages, or third-party service disruptions.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forge by PlayAmigos regarding the use of the Service, superseding any prior agreements or understandings.

17. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where required by law, by providing notice via email. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
